Raffle Terms and Conditions
These are the official Sweepstakes rules (”Rules”) for the Nohble Release Raffle (”Raffles”).
Eligibility: NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE ODDS OF WINNING. The Sweepstakes is open to residents of the Continental United States (excludes Hawaii, Alaska, and other territories and possessions), which includes the District of Columbia, who are 18 years of age or older at the time the Sweepstake commences. Employees, officers, and directors (and their immediate family members and members of the same households, whether related or not) of Company are not eligible to participate. The Sweepstakes is subject to all federal, state and local laws and regulations and is void where prohibited by law or regulation.
How to Enter: Qualifying participants (see each raffle's rules for entry) must submit entries within the time limit as assigned by the raffle. Participants must submit the required materials for the Sweepstakes which will register he/she for a chance to buy a pair of the release shoes associated with the raffle. Participant may be asked for name, address, e-mail address, phone number, size, and entry store pick-up location. Limit one entry per person. Additional entries will be disqualified. Incomplete entries will be disqualified. All Entries become the property of Company and will not be returned. Company is not responsible for lost, late, illegible, misdirected, mutilated, or incomplete entries or other errors of any kind whether human, mechanical or electronic, which may limit a participant’s ability to participate in the Sweepstakes. Company reserves the right to cancel or modify the Sweepstakes for any reason as determined by Company at its sole discretion. Entry to Sweepstakes by Participant constitutes permission to use Participant’s name, contact information including but not limited to phone number, email, and/or mailing address, social media, and/or likeness for purposes of advertising, marketing, and/or trade, worldwide in perpetuity, without future compensation, unless prohibited by law.
Prize & Winner Selection: Potential winners will be selected accordingly to the terms of each individual raffle. Prize is the right to buy an item for sale by Company. Winner will have 24 hours to complete their purchase upon notified that they have won. If item is being picked up at one of our retail locations, winner must show a valid photo ID that matches the name on the order to purchase the sneakers. If the name on the valid photo ID does not match the name on the entry, that entrant will be disqualified. Failure to pay in full will result in disqualification. Company will select one potential winner per available item per store. No substitution or compensation shall be awarded. Prize will be assigned to winners at the sole discretion of the Company. Winner will redeem prize according to each raffle rules - in person or via mail. If a winner cannot be contacted or does not pick up prize within the 24 hour window or is disqualified for any reason, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, at its sole discretion. Acceptance of prize offered constitutes permission to use Winner’s name, contact information including but not limited to phone number, email, and/or mailing address, and/or likeness for purposes of advertising, marketing, and/or trade, worldwide in perpetuity, without future compensation, unless prohibited by law. Entering the Sweepstake is considered a confirmation of eligibility on behalf of the Participant in accord with these rules and any pertaining local/federal/international laws.
Conduct & Decisions: The Company, in its sole discretion, reserves the right to disqualify and prohibit from participating any Participant, who the Company determines at its sole discretion is or is attempting to: (i) tamper with the Company’s Website and/or any part of the Sweepstake; (ii) attempting to undermine the legitimate operation of the Sweepstake by cheating, deception, or other unfair playing practices, (iii) intending to annoy, abuse, threaten or harass any other participants or the Company’s Agents; and/or (iv) otherwise violating these Official Rules or the Terms of Use of the Company’s Website. (b) ANY ATTEMPT TO DELIBERATELY DAMAGE THE COMPANY’S WEBSITE OR STOREFRONT OPERATIONS (OR ANY PART THEREOF) OR UNDERMINE THE OPERATION OF THIS SWEEPSTAKE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, THE COMPANY AND ITS LICENSEES (IF ANY) RESERVE THE RIGHT TO SEEK DAMAGES AND ANY OTHER AVAILABLE REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. EACH ENTRANT (OR, IF THE ENTRANT IS NOT OF AGE OF MAJORITY IN HIS/HER STATE OF RESIDENCE, THE LEGAL GUARDIANS THEREOF) AGREES TO INDEMNIFY AND HOLD HARMLESS THE COMPANY AND ITS AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES AND/OR LIABILITIES (INCLUDING REASONABLE ATTORNEYS' FEES AND EXPENSES) THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY OF THEM AT ANY TIME, IN CONNECTION WITH THE USE THEREOF, AND/OR BY ENTRANT’S BREACHES OF ANY REPRESENTATION, WARRANTY OR COVENANTS ASSOCIATED WITH THIS SWEEPSTAKE. Failure to comply with these Rules may result in Participant’s disqualification from the Sweepstake. Any false information provided within the context of the Sweepstake by any Participant, including but not limited to identity, postal address, ownership of rights or non-compliance with the Rules may result in the immediate disqualification of such Participant from the Sweepstake. Company further reserves the right to disqualify any entry that it believes in its sole and unfettered discretion, infringes upon any third party right, violates any law, or otherwise does not comply with these Rules.
Release Waiver /Indemnification: In consideration of the opportunity to participate in the Sweepstake, Participant hereby agrees to release, discharge and hold harmless Company and its officers, directors, subsidiaries, members, agents, employees, volunteer staff, successors and assigns from any and all liability that may arise directly or indirectly, now or in the future, by reason of any injury, damage, loss or expense incurred in connection with the operation of the Sweepstake and/or Participant’s participation in any aspect of the Sweepstake, including but not limited to any medical costs incurred.
Binding Agreement: In order to enter the Sweepstake, Participant must agree to these Official Rules ("Rules"). The Rules consist of the terms and conditions in this document. Because these Rules form a legally binding agreement with respect to this Sweepstake, Participant must read them carefully. If Participant does not agree to the Rules, Participant is not eligible to participate in the Sweepstake or to win any of the prizes. Participant agrees that submission of an entry in the Sweepstake constitutes a binding agreement to these Rules.
Jurisdiction: Any dispute that may arise hereunder shall be brought solely in the appropriate state or federal court sitting in New Jersey and entrants consent to the personal jurisdiction and venue of such court. Participant further agrees to comply with and be bound by the decisions of the judges, which are final and binding in all matters pertaining to the Sweepstake. Participant further agrees that any disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action.
Severability: If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect Amendments & Modifications Company reserves the right to update the terms and conditions at any time without notification.
